'HEALTH & SAFETY' REGULATIONS
The ' Provision and Use of Work Equipment Regulations 1998', and 'European Council Directive 95/63/EC' concerning the minimum safety and health requirements for the use of work equipment by workers at work specify the need for a 'restraining system' (i.e. Seat Belt) in conjunction with Roll Over Protection Systems (ROPS) where there is a risk of anyone carried being crushed between the machine and the ground in an overturn.

TYPES OF VEHICLE AND REQUIREMENTS
Mobile Work Equipment (i.e. Forklifts, Industrial / Construction / Agricultural / Horticultural / Forestry Vehicles).
 - manufactured since 5/12/98 shall have a 'restraining system'.
 - manufactured prior to 5/12/98 shall have a 'restraining system' fitted by 5/12/2002.

Note: Lease & Hire equipment is treated as 'New equipment' at each Lease or Hire.

ACCIDENTS
Overturning accidents are not confined to steep slopes. Fifty per cent of investigated overturning accidents occurred on slopes of 10° or less and half of these on slopes of 5° or less.

RISK ASSESSMENT
The Regulations require Owners/Operators to carry out a 'Risk Assessment' of their Work Equipment and provide a restraining system where anyone being carried is at risk .As 25% of investigated overturning accidents are on slopes of 5° or less Owners/Operators will find it extremely difficult to justify not providing restraints.
